Port Authority Act 61

Effective September 11, 2012, Act 61 of 2012 transfers oversight of all passenger transportation within Allegheny County from the Port Authority to the Pennsylvania Public Utility Commission. Carriers that are currently authorized by the Port Authority to provide service within Allegheny County will retain their authority through the Commission. Those carriers are subject to Commission rules and regulations, including safety, operational, insurance and tariff requirements. Affected carriers must provide proof of insurance in addition to filing a tariff.

Order - From the Public Meeting of Aug. 30, 2012, at Docket No. M-2012-2318841. The order explains that the existing carriers will retain their authority through the PUC and also provides further details on the necessary filings and other information a company must provide to the Commission.

The Commission’s jurisdiction has been expanded to include contract carriers and common carriers providing service such as scheduled route service, call or demand service, group and party service, limousine service, airport transfer service and experimental service. For other companies wishing to provide service within Allegheny County that are not currently authorized to do so by either the Port Authority or the PUC, those carriers must file an application for authority with the Commission.
