Electric Retail Markets

After studying developments in retail and wholesale energy markets with the objective of developing a final version of these regulations, including the integration of the requirements of the Alternative Energy Portfolio Standards Act of 2004, 73 P.S. § 1648.1, et seq., the Commission determined that some elements of the default service regulatory framework would be best addressed in the context of a policy statement that provides guidance to the industry as opposed to strict rules. The Commission determined that a policy statement would be more readily subject to change, and can provide needed flexibility in the context of default service as energy markets continue to develop. The Commission adopted a policy on Default Service and Retail Electric Markets (§ 69.1801-17), but determined that there were number of issues where opportunities existed to enhance customer choice and facilitate the development of retail markets. These issues, found at §§ 69.1812-17, were referred to the Retail Markets Working Group for study and policy recommendations.
